General terms and conditions Bonyours BV


Article 1. Definitions

1.1 Webshop Bonyours BV: established in Voorburg and registered with the Chamber of Commerce under registration number 93076940, trading under the name Bonyours BV (hereinafter referred to as Bonyours)

1.2 Website: the Bonyours website can be consulted via www.bonyours.nl and all associated subdomains.

1.3 Customer: the natural person who, not acting in the exercise of a profession or business, enters into an Agreement with Bonyours and/or has registered on the website.

1.4 Agreement: any arrangement or agreement between Bonyours and the customer, of which the General Terms and Conditions form an integral part.

1.5 General Terms and Conditions: the current General Terms and Conditions.


Article 2. Applicability of General Terms and Conditions

2.1. The General Terms and Conditions apply to all offers, agreements, and deliveries from Bonyours, unless expressly agreed otherwise in writing.

2.2. If the Customer includes provisions or conditions in their order, confirmation, or notification of acceptance that deviate from, or do not appear in, the General Terms and Conditions, these will only be binding on Bonyours if and to the extent that Bonyours has expressly accepted them in writing.

2.3. In the event that specific product or service conditions apply in addition to these General Terms and Conditions, those conditions will also apply, but in the event of conflicting conditions, the Customer may always invoke the applicable provision that is most favorable to him.

2.4 The moment the Customer places an order on the Bonyours website, the agreement becomes binding. Bonyours will process the order once the payment obligation has been met. Until this payment obligation has been met, Bonyours retains full ownership of the product(s).


2.5 Once your order has been processed, you will receive a confirmation email containing the details of your order and confirming that your payment has been accepted.

2.6 This agreement is governed by Dutch law. This does not affect mandatory consumer rights under the laws of the country in which the consumer resides.


Article 3. Prices and information

3.1. All prices listed on the website and in other materials originating from Bonyours include VAT and, unless otherwise stated on the website, other government-imposed levies. However, shipping costs are not included in the sales price; these will be calculated separately later in the ordering process. 3.2. The content of the Website has been compiled with the utmost care. However, Bonyours cannot guarantee that all information on the Website is always correct and complete. Therefore, all prices and other information on the Website and in other materials originating from Bonyours are subject to obvious programming and typographical errors.

 

Article 4. Payment

4.1. Payments are made directly on the website.

4.2. You can choose from various secure payment methods, including but not limited to: iDEAL, Creditcard, Mastercard, Visa, PayPal, Klarna, Bancontact, Cartes Bancaires, Bancomat, MBWAY, Multibanco, etc.

4.3. All your payment information is automatically transferred to the payment processor via an encrypted, secure system, without Bonyours or third parties having access to it. This information will also not be disclosed to Bonyours or third parties for any refunds.


Article 5. Delivery

5.1. Delivery will take place while stocks last.

5.2. Delivery of products ordered online will take place at the address specified by the Customer.

5.3. For orders placed on business days, we aim to ship them the same day, but in any case within 24 hours of receiving your payment. In most cases, orders will be delivered within 1-3 business days in the Netherlands. For deliveries outside the Netherlands, the indicative delivery times stated in Article 5.6 apply.

5.3. Orders placed after 2:00 PM on Friday will be shipped on Monday and, in most cases, delivered within 1-3 business days in the Netherlands. For international orders, the estimated delivery times stated in Article 5.6 apply.

5.4. The delivery times indicated by Bonyours are indicative and do not entitle the Customer to cancellation or compensation if they are exceeded.

5.5 Exceeding the stated delivery time does not give the Customer the right to terminate the agreement, but Bonyours will make every effort to deliver the order on time.

5.6 For deliveries outside the Netherlands, the standard delivery times listed under 5.1 will be extended by 2-4 business days. Additional taxes and levies may also apply. For more information, we recommend contacting your local customs department. Below are the indicative delivery times per country:

Belgium: 1-2 working days

France: 2-4 working days

Luxembourg: 2-3 working days

Germany: 2-3 working days

Spain: 3-5 working days

Portugal: 5-7 working days

Italy: 4-6 working days


Article 6. Complaints

6.1. Bonyours naturally strives to satisfy all customers by delivering high-quality products. However, we advise you to check the quality and quantity of the delivered goods within 14 days. If anything is not satisfactory, please send an email to info@bonyours.com, and we will find a suitable solution as quickly as possible.

6.2. As soon as the products to be delivered have been delivered to the specified delivery address, the risk with regard to these products passes to the Customer.


Article 7. Right of withdrawal

7.1. The Customer has the right to cancel the distance contract with Bonyours within 14 days of receiving the product(s), without giving any reason and free of charge.

7.2. The term commences on the day after the Customer, or a third party designated by the Customer in advance, who is not the carrier, has received the product, or:

- if the Customer has ordered multiple products in the same order, the day on which the Customer, or a third party designated by the Customer, has received the last product;

-if the delivery of a product consists of multiple shipments or parts; the day on which the Customer, or a third party designated by the Customer, has received the last shipment or the last part;

- in the case of an Agreement for regular delivery of products during a specific period, the day on which the Customer, or a third party designated by him, has received the first product.

7.3. The Customer must bear the return costs themselves. Shipping costs incurred by the Customer when purchasing the product are not included in the return costs and remain the Customer's responsibility.

7.4. Within the withdrawal period specified in 7.1., the Customer will handle the product and its packaging with care. The Customer will only open the packaging and use the product to the extent necessary to check the nature, characteristics, and functioning of the products. This inspection should not go beyond what the Customer would be able to do in a physical store.

7.5. The Customer can no longer return the delivered product(s) if the conditions as described in 7.4 have not been met.

7.6. The Customer may cancel the agreement within the period specified in 7.1. by notifying Bonyours of this by means of the model for withdrawal and/or cancellation or by sending an email to info@bonyours.com.

7.7. The Customer is obligated to return the products in question, along with the returns form received, to Bonyours within 14 days of notifying Bonyours of their right of withdrawal.

7.8. Bonyours customer service will provide the Customer with all necessary information to return the item(s).

7.9. The costs for the return shipment are borne by the Customer.

 

Article 8. Warranty and Conformity

8.1. The warranty with respect to products applies exclusively to defects caused by defective manufacturing, construction or material.

8.2. The warranty does not apply in the event of normal wear and tear and damage resulting from accidents, modifications to the product, negligence or improper use by the Customer, or when the cause of the defect cannot be clearly determined.

8.3. The risk of loss, damage or theft of the products that are the subject of an agreement between the parties shall pass to the Customer at the moment when they are legally and/or actually delivered, or at least come into the possession of the Customer or of a third party who receives the product on behalf of the customer.
